Pennsylvania law guarantees patients the right to have copies of their medical records at a reasonable cost set by law. You can access your records if you have sustained a personal injury, whether it's the result of a car wreck, a slip and fall accident or any other type of accident.
All health-care providers must provide patients and their attorneys with photocopies of their medical charts and records without requiring a court subpoena, according to the Medical Records Patients' Rights Act of 1998, which went into effect on April 19, 1998.
The copies must be delivered within 30 days of the request and must be "legible and durable."
The act defines maximum charges that may be levied for retrieving, copying and delivering the records, but no other charges may be imposed on patients or patients' attorneys. Providers are entitled to require payment for records before delivery.
The act also provides that a patient or a patient's attorney can obtain the original medical records if necessary to compare with reproduced records or to prove an issue in dispute.
In New Jersey, you also have the right to obtain copies of your medical records at a reasonable cost.
