Both Pennsylvania and New Jersey automobile insurance policies provide Personal Injury Protection (PIP) benefits for payment of certain motor vehicle collision-related expenses such as medical bills, loss wage replacement and funeral expenses. These benefits are provided without any determination of fault on the party making the claim.
However, each state has a very different insurance scheme for providing these benefits. In Pennsylvania, every automobile insurance policy must provide a mandatory minimum amount of coverage for medical expenses in the amount of $5,000. An insured can choose a higher amount of coverage up to $100,000. In New Jersey, the amount and type of PIP benefits is determined by the type of coverage chosen by the insured. Under a “standard” policy, the insured can choose from $15,000 to $250,000 in medical coverage, along with other benefits such as lost wages and death benefits. “Basic” PIP coverage provides for only $15,000 in medical coverage, but allows additional coverage up to $250,000 for certain permanent and significant injuries like brain damage or a spinal cord injury. Additionally, New Jersey provides a low cost PIP coverage option called a “special” policy which has even more restrictive benefits than a basic policy.
The interaction of PIP coverage with other sources of insurance like health insurance and workers’ compensation can be confusing, especially when an injured person is trying to deal with their injuries.
